Din???ABSTRAK Qanun Aceh Nomor 9 Tahun 2008 memberi peluang perkara-perkara tertentu dapat diselesaikan secara kekeluargaan, namun kenyataannya banyak perkara yang sudah selesai melalui peradilan adat tetap diajukan ke pengadilan dan diputuskan dengan menghukum pelaku. Penelitian ini mempermasalahkan perdamaian menurut hukum Adat dapat menghentikan proses peradilan, perdamaian menurut hukum adat dapat menghilangkan sifat melawan hukum, efektifitas putusan perdamaian dalam memenuhi rasa keadilan masyarakat. Penulisan ini bertujuan untuk membahas perdamaian dalam hukum adat dalam kaitannya dengan proses peradilandan menghilangkan sifat melawan hukumserta efektifitas putusan perdamaian dalam kaitannya dengan rasa keadilan masyarakat.Jenis penelitian ini bersifat deskriptif analisis yang mendekripsikan penerapan suatu norma hukum dalam masyarakat secara cermat, menyeluruh dan sistematis. Penelitian ini menggunakan metode yuridis empiris. Data sekunder .diperoleh dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier, sedangkan data primer diperoleh dari hasil wawancara . Hasil penelitian menunjukan bahwa pada tingkat penyidikan apabila terjadi perdamaian menurut hukum adat, maka proses penyidikan perkara dihentikan, pada tahap pra penuntutan dan penututan oleh Kejaksaanpada dasarnya dapat dilakukan penghentian penyidikan melalui mekanisme deponiring yang merupakan kewenangan Jaksa Agung. Hal tidak pernah dilakukan karena alasan tehnis dan proses yang panjang Pada tingkat pemeriksaan pengadilan tidak dikenal penghentian peradian, hanya ada keputusan dibebaskan atau perdamaian hanya alasan yang meringankan hukuman. perdamaian dalam suatu peristiwa pidana pada dasarnya telah memulihkan suatu kondisi kepada keadaaan semula, tidak ada lagi pihak-pihak yang dirugikan , seolah-olah peristiwa tidak pernah terjadi. Disarankan Kepolisian agar memberi pemahaman kepada pihak yang bersengketa yang menyangkut perkara-perkara sebagaimana diatur dalam pasal 12 Qanun Aceh Nomor 9 Tahun 2008 tentang Pembinanaan Adat dan Adat Istiadat untuk terlebih dahulu melakukan penyelesaian perkara pidana pada peradilan Adat Gampong dan Mukim sebelum menerima laporan atau pengaduan. Kejaksaan dan Pengadilan agar mempertimbangkan perkara yang telah diselesaikan secara damai melalui penradilan Adat dan menganulir perdamaian dalam putusaanya, serta memperhatikan kehendak pihak dalam perdamaian dalam keputusannya.Kata Kunci : Perdamaian dalam hukum adat.
