Untuk memperoleh data dalam penulisan skripsi ini dilakukan penelitian kepustakaan dan penelitian lapangan. Penelitian kepustakaan dilakukan dengan mempelajari berbagai literatur baik berupa peraturan perundang-undangan, buku-buku, dan teori-teori guna memperoleh data sekunder, sedangkan penelitian lapangan dengan mewawancarai responden guna memperoleh data primer. Berdasarkan hasil penelitian diketahui bahwa pada saat proses terjadinya perjanjian asuransi jiwa, dimana pihak tertanggung mengajukan permohonan diadakannya perjanjian asuransi jiwa kepada pihak penanggung dan menyetujui segala persyaratan yang diberikan serta menandatangani perjanjian asuransi jiwa. Polis baru diterbitkan 12 hari sejak tertanggung menandatangani perjanjian asuransi tersebut, sehingga tertanggung tidak dapat membaca secara langsung dan memahami secara seksama ketentuan yang diatur di dalam polis. Hal ini tentunya akan berakibat pada pemenuhan hak dan kewajiban para pihak pada saat pelaksanaan perjanjian. Selain itu dalam pelaksanaan hak dan kewajiban para pihak dalam perjanjian asuransi jiwa terjadinya wanprestasi, dimana pihak tertanggung melalaikan kewajibannya dengan terlambat membayar premi, atau tidak memenuhi kewajibannya untuk membayar premi. Upaya yang dilakukan oleh penanggung bagi tertanggung yang terlambat membayar premi akan diberikan tenggang waktu, dan juga adanya pemulihan polis apabila polis dinonaktifkan. Dalam hal pemahaman tertanggung akan isi dan ketentuan polis diberikan waktu yang tidak terbatas untuk itu, dan apabila ada hal-hal yang tidak dipahami tertanggung dapat langsung berkonsultasi dengan pihak penanggung.
