Salah satunya adalah kejahatan pornografi terhadap anak melalui internet yang menunjukkan gejala peningkatan di Indonesia. Landasan hukum khusus di Indonesia yang melarang pornografi adalah Undang-Undang Nomor 44 Tahun 2008 Tentang Pornografi. Sedangkan di Amerika Serikat, Undang-Undang Federal yang melarang pornografi teraktual, yaituAdam Walsh Children Protection and Safety Act of 2006.Oleh sebab itu, menarik untuk melihat perbandingan peraturan perundang-undangan sertapenerapan sanksi di Indonesia dan Amerika Serikat. Sebab dalam Undang-Undang Nomor 44 Tahun 2008 di Indonesia masih terdapat celah yang memungkinkan pelaku kejahatan pornografi lepas dari jeratan hukum pidana.Tujuan dari penulisan skripsi ini adalah untuk meneliti serta menjelaskan perbandingan tentang peraturan Perundang-undangan dan sanksi terkait tindak pidana pornografi terhadap anak melalui internet menurut Undang-Undang yang berlaku di Indonesia dan Amerika Serikat. Sehingga dapat dijelaskan perbandingan penerapan hukum di Indonesia dan Amerika Serikat yang menganut sistem hukum yang berbeda tersebut.Penelitian ini merupakan penelitian hukum komparatif, yakni suatu penelitian ilmiah yang menganalisa ketentuan hukum normatif, dengan melakukan pendekatan peraturan perundang-undangan dan pendekatan perbandingan. Dilakukan dengan studi kepustakaan atau library research, yaitu penelitian yang mengkaji bahan-bahan hukum primer, sekunder dan tersier.Berdasarkan hasil penelitian ditemukan bahwa undang-undang di Indonesia tidak mengkriminalkan penyedia layanan elektronik atau pembuat nama domain palsu di media online yang memudahkan akses pada materi yang mengandung pornografi terhadap anak, ketiadaan Lembaga yang mampu mengawasi informasi di jaringan internet serta tidak adanya sanksi administratif yang ketat bagi pelaku kejahatan pornografi terhadap anak. Oleh sebab itu, di Amerika Serikat kejahatan pornografi terhadap anakmelalui internet lebih mudah untuk dicegah dan dikenakan sanksi pidana bagi pelanggar kejahatan tersebut.Disarankan kepada pembentuk Undang-Undang di Indonesia agar segera merevisi Undang-Undang Nomor 44 Tahun 2008, membuat kebijakan kriminal terhadap penyedia layanan media elektronik atau pembuat nama domain palsu di media online, serta menerapkan sansksi administratif yang ketat bagi pelaku kejahatan pornografi terhadap anak melalui internet.
