Di Amerika Serikat juga menjunjung tinggi perwujudan demokrasi melalui sistem pemilu dalam hal ini pemilu presiden dan wakil presiden yang diatur dalam Konstitusi Amerika Serikat Tahun 1787 artikel satu dan dua. Terdapat persamaan dan perbedaan antara perwujudan demokrasi melalui sistem pemilu presiden dan wakil presiden antara Indonesia dan Amerika Serikat.Adapun tujuan penelitian ini adalah untuk menjelaskan dan mengetahui persamaan dan perbedaan pemilihan umum presiden dan wakil presiden di Indonesia dan Amerika Serikat dan untuk menjelaskan serta mengetahui faktor yang menjadi latar belakang perbedaan tersebut.Penelitian ini merupakan penelitian Yuridis Normatif dengan metode deskriptif yang menggunakan data kepustakaan (Library Research) yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, serta untuk menunjang data sekunder dilakukan wawancara dengan para ahli Hukum Tata negara. Dan terhadap semua data dianalisis secara kualitatif.Hasil penelitian menunjukkan bahwa sistem pemilihan umum presiden dan wakil presiden di Indonesia menggunakan sistem proportional dengan sistem kepartaian multi partai. Sedangkan di Amerika Serikat menggunakan sistem pemilihan umum distrik murni dengan sistem kepartaian dua partai. Dan persamaan sistem pemilihan umum presiden dan wakil presiden ada pada pemilih yang memilih pemimpin mereka secara langsung dalam hal bentuk pelaksanaan demokrasi. Faktor yang menjadi latar belakang perbedaan tersebut adalah faktor sejarah demokrasi masing negara, faktor wilayah dan perwakilan dan faktor pendidikan dan politik.Disarankan kepada Pemerintahan Republik Indonesia agar pada pemilihan umum presiden dan wakil presiden berikutnya dapat menggunakan sistem dua partai dengan bercermin pada kesuksesan pemilu di Amerika Serikat, dengan partai politik peserta pemilihan umum (dengan bakal calon presiden dan wakil presiden) tidak berjumlah banyak sehingga dapat memperkecil terjadinya perselisihan dan sengketa.Dan peningkatan jenjang pendidikan untuk syarat calon presiden dan wakil presiden. Namun pada dasarnya, komitmen Indonesia dalam mewujudkan demokrasi dalam pemerintahan adalah hal yang lebih penting terlepas dan kekurangan-kekurangan atau kendala-kendala yang dihadapi oleh Indonesia. AJB Bumiputera merupakan perusahaan asuransi jiwa nasional yangpertama dan tertua di Indonesia. Perusahaan asuransi ini terbentuk pada tanggal 12 Februari 1912, di Magelang, Jawa Tengah dengan namaOnderlinge Levensverzekering Maatschappij PGHB disingkat denganOL.MIJ. 2. Tata cara perekrutan agen asuransi pada PT AJB BUMIPUTERA 1912 Banda Aceh adalah sebagai berikut : a. Tahap seleksi yang sudah melamar, diintervew oleh Supervisor dan Kepala Unit Pemasaran untuk mengetahui dan menjelaskan Job Desc seorang agen asuransi; b. Posisi agen di PT AJB Bumiputera 1912 Banda Aceh, merupakan mitra kerja bagian pemasaran yang dinamakan dinas luar/ marketing; c. Agen yang diperbolehkan oleh AAJI untuk melakukan penjualan jasa asuransi harus mempunyai lisensi keagenan dari lembaga pemerintah yang dinamakan AAJI; 43 44 d. Untuk mendapatkan kartu lisensi keagenan, calon mengikuti ujian yang difasilitasi oleh tempat agen itu mendaftar; e. Setelah dinyatakan lulus dengan hasil ujian tersebut, agen tersebut berhak melakukan penjualan polis asuransi; f. Selanjutnya baru dibuat perjanjia kontrak kerja pertahun (SPK) keagenan; dan g. Setelah semua selesai, agen dipersilahkan untuk menjual asuransi. 5.2 Saran Berdasarkan pembahasan yang telah disimpulkan di atas, maka penulis menyarankan agar PT AJB Bumiputera 1912 Banda Aceh dapat mempertahankan tata cara perekruitan agen yang baik, sehingga meningkatkan kualitas perusahaan di masa yang akan datang. This research aimed at figuring out the description of process of recruitment, selection, and replacement and also the obstacles in recruitment, selection and replacement of State Junior High School principal at Education Agency of Banda Aceh. This research employed descriptive qualitative method. Data was collected by using observation, interview, and documentation technique. Subject of the research was principal and teacher at State Junior High School. The result of the research showed that: first, the recruitment process, the Education Agency prepared a recruitment program comprising of implementation and technical guidance of recruitment implementation for the candidates of principal, then there was an official announcement from the Education Agency. Second, the selection process on the principal candidates comprised of administrative selection carried out through the assessment of the completeness of documents and academic selection carried out through the assessment of the leadership potential and initial mastery of toward competence of principal. Third, the replacement process of principal candidates was conducted because there was principal vacancy caused by the transfer, retirement, and dismissal. Fourth, the obstacles in recruitment, selection, and replacement of the principalwere lack of interest of the teachers to run for principal and lack of the budget for principal recruitment.
